The hereby stated sales conditions are concluded of the one part by Wisted prod, a private limited company with its head office in Bordeaux, registered at the Trade and Company Register of Bordeaux under the number RCS Bordeaux: 452 109 325 – Company registration number: 452 109 325 00012 - Principal Activity Code: 921 A, owner and editor of Bewineconnected products and services, hereafter referred to as ‘Bewineconnected’, and of the other part, by all natural or legal person wishing to proceed with a purchase on the Bewineconnected site, hereafter referred to as ‘the Buyer”.

Object
The sales conditions of this document aim to define the contractual relations between Bewineconnected and the Buyer and the applicable conditions for every purchase completed through the Bewineconnected sales site, be the buyer either professional or consumer.
The acquisition of a product or service through the site implicates the prior acknowledgement and acceptance of all conditions of this sales conditions document by the Buyer.
The conditions of this document prevail any other general or particular conditions not specifically agreed to by Bewineconnected.
Bewineconnected reserves the right to modify its sales conditions at any moment. In this case, the sales conditions applicable will be those effective at the date of purchase by the Buyer.

Characteristics of products and services offered
The products and services offered are listed in the catalogue published in the Bewineconnected site.
These products and services are offered within limits of available stock.
The photographs in the catalogue are as close to reality as possible, but can only achieve perfect similarity with the offered product, notably concerning the colours.

Prices
The prices stated in the catalogue are in Euro, including tax, and make allowance for TVA applicable in France at the effective date of the order. Any change of taxes could be allocated to the product or service prices.
Bewineconnected reserves the right to modify its prices at any moment. However, it is understood that the prices listed in the catalogue at the effective day of the order will be the price applicable to the Buyer.
The indicated prices don’t include the processing of the orders, transport and delivery costs for as many geographical zones as listed below.

Geographical area
The online sale of products and services on the site is provided for all the countries listed on the online sales site www.bewineconnected.com.

Orders
The Buyer, who wishes to buy a product or service, must obligatory:

• fill in the identification form on which he will indicate all the details required;
• fill in the online order from, indicating the number of products chosen;
• confirm the order after having verified;
• make the payment in accordance to the listed conditions;

The confirmation of the order and payment leads to acceptation of these sales conditions, the acknowledgement and full awareness of these conditions, and to act within these sales or other conditions.
The provided data set and the recorded confirmation are proof of the transaction. The confirmation will constitute signature and acceptance of these operations carried out.
Bewineconnected will communicate per email the confirmation of the recorded order.

Order Retraction
The Buyers, non-professional individuals, benefit of a retraction delay of seven days from the delivery of the order to send the product back to the seller for exchange or reimbursement without penalty, with exception of shipping costs, which will be at their expense.

Terms of Payment
The price is due at the moment of the order.
Payments are made by credit card, via the secured system Cybermute. This system uses the SSL (Secure Socket Layer) protocol, by which transmitted information will be software crypted and no third party can view, intercept or alter during transfer on the network.
The Buyer’s account will be debited at the moment of shipment of the products or services available and only for the total amount of the products or services sent or downloaded.
At request, the Buyer will receive an invoice stating the VAT per email.

Delivery
Deliveries will be made to the address indicated on the order from, which can only be situated in the geographical zones listed before.
The Buyer accepts transport risks from that moment when the merchandise has left the premises of Bewineconnected. In case of transport damage, the reasoned protest must be put forward to the transport company within three days of delivery.
Transport delays are only of an indicative nature. If the delay should be longer than thirty days after the order date, the sales contract will be cancelled and the Buyer reimbursed.

Choice of transport
In order to keep shipping costs low, Bewineconnected offers Standard Service shipment to send your good purchased without guarantee or insurance. Our secure packaging will provide for the perfect state of your USB flash drive. However, Bewineconnected also offers an all guaranteed shipping. The Buyer has the option of Tracking Service and insured shipping with AR Form, which is at the Buyer’s charges. To choose this option you only need to tick the corresponding case on the order form.

Guarantee
All products provided by the seller benefit of the legal guarantee specified in the article 1641 and following in the French Civil Code.
In case of non-conformity of a product sold, it may be returned to the seller who will take it back and exchange it or reimburse, according to his possibilities.
All claims or requests for exchange or reimbursement must be made within thirty days from delivery date via mail to the following address: Wisted Prod – 92 Bis Rue Camille Godard – 33000 Bordeaux – France.

Responsibility
Bewineconnected is in the process of online sales only bound by an obligation of means. It is not liable for damage as a result of use of Internet network such as loss of data, intrusion, viruses, interruption of service, or other involuntary problems.

Intellectual property
All elements of the Bewineconnected site are and remain the intellectual property exclusively of Bewineconnected.
Bewineconnected grants you reproduction or redistribution of elements on the site, be they in text, visual or sound, under the condition to expressly quote the source http://www.bewineconnected.com.
Bewineconnected grants you to establish hyperlinks towards pages of its website http://www.bewineconnected.com.
However, these implicit authorizations will not engage the responsibility of Bewineconnected, in respect to further usage of its media or its links beyond its web site http://www.bewineconnected.com.

Personal Data
In agreement with the law about information technology, the act of 6th January 1978, personal data sheet information, relating to buyers, may be object of data processing.
The usage of cookies by the site is reserved to storage of language preferences and the follow up of the session; its content will not be stored.
Bewineconnected collects information about the buyers, and reserves the right to transmit this collected information to its commercial partners.
Buyers may oppose to the transmission of their personal date by indicating this refusal to Bewineconnected. According to the act of 6th January 1978, buyers have likewise the right to access and rectify the concerning data.
The processing of data, including the management of email addresses of site users has been declared to the CNIL on…….., registered under the number……….

Archiving - Proof
Bewineconnected archives the order receipts and invoices on a reliable and lasting support, which constitutes a true copy in accordance to provisions in the article 1348 of the Civil Code.
The parties will consider the computerized registers of Bewineconnected as proof of communication, orders, payments and transactions between the parties.

Settlement of dispute
French law will govern the conditions of online sale of the present document.
In case of dispute, the Tribunal of Bordeaux will have competence, notwithstanding multiple defendants or guarantee of appeal.
